Why Trademark Protection Matters

Registering a business name with your state does not give you trademark rights. A state filing simply reserves the name for use within that state’s business registry—it does not prevent another company from using the same or a confusingly similar name in commerce.

A federal trademark registered with the U.S. Patent and Trademark Office provides nationwide protection for your brand name, logo, or slogan. It gives you the exclusive right to use that mark in connection with the goods or services you specify, and it puts others on legal notice that the mark is yours.

Without a federal trademark, another business could adopt the same or a similar name and operate freely, potentially causing confusion among your customers and diluting the brand you’ve built. Federal trademarks last indefinitely, as long as you continue using the mark and file the required maintenance documents on schedule.

Additional classes: billed at the USPTO base rate of $350 per class. (The January 2025 USPTO fee restructure raised the per-class base fee from $250 to $350; details here.)

Process

  1. Comprehensive search to vet your mark for potential conflicts
  2. Classification of your goods/services under the appropriate Nice Classification categories
  3. Application prepared and filed with the USPTO
  4. USPTO examination (typically 3–4 months after filing)
  5. Publication for opposition (30-day window for third parties to object)
  6. Registration certificate issued

Timeline: 8–12 months from filing to registration is typical. Some applications may take longer depending on USPTO workload or issues raised during examination.

Filing Basis

When you apply, you’ll file under one of two bases:

  • Section 1(a) — Use in Commerce: Your mark is already being used in connection with the goods or services identified in the application.
  • Section 1(b) — Intent to Use: You plan to use the mark but haven’t started yet. A Statement of Use must be filed before the USPTO will issue the registration.

What We Don’t Cover

We believe in being upfront about the scope of our services. We do not handle trademark litigation, cease-and-desist letters, opposition proceedings before the Trademark Trial and Appeal Board (TTAB), or international trademark filings. These matters involve specialized legal work that falls outside the filing services we provide.
